Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Digital Products, Usage & Refund Policy
All products available on CIVILHEX are digital goods (including e-books, spreadsheets, downloadable files, and digital resources) delivered electronically immediately after successful payment.
Strict No-Refund Policy on Accessed Content: Once a digital product has been delivered or accessed, all sales are final. Digital content cannot be returned, revoked, or resold. Please review product descriptions, previews, and compatibility requirements carefully before purchasing.
Exceptions for Refunds:
- The digital file is technically defective or corrupted and cannot be accessed.
- The issue cannot be resolved by CIVILHEX support within a reasonable timeframe.
Refunds will NOT be provided for:
- Change of mind after purchase.
- Lack of required technical knowledge or software skills.
- Incompatibility with specific third-party software not listed in the requirements.
- Failure to read the product description.
2. Educational Purpose & Professional Disclaimer
All content provided by CIVILHEX, including e-books, calculations, code summaries, and downloadable materials, is intended solely for educational and informational purposes.
Not Professional Advice: The materials do not constitute professional engineering advice, consultancy services, or licensed design approval. Users are responsible for applying their own professional engineering judgment and must verify all information against applicable local codes (e.g., BNBC, ACI, ASCE), standards, and regulations. CIVILHEX shall not be held liable for any direct, indirect, or consequential damages resulting from the use or misuse of the provided materials.
3. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of CIVILHEX and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries.
License to Use: Purchasing a product grants you a non-transferable, non-exclusive license for personal, non-commercial use. You may not distribute, share, resell, or publicly display any content purchased from CIVILHEX without our prior written permission.
4. Limitation of Liability
In no event shall CIVILHEX, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use or alteration of your transmissions or content.
CIVILHEX’s total liability to you for any claims arising from the use of the Service is limited to the amount you have paid to CIVILHEX for the specific product or service giving rise to the claim, or 100 USD if no purchase was made.
5. “AS IS” Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
CIVILHEX does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; or c) the results of using the Service will meet your requirements.
6. Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by CIVILHEX. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites you visit.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
